Terms and Conditions of Interpark Global Shopping Service Electronic Financial Transactions

Chapter 1. General Terms

Article 1. Purpose

The purpose of these Terms and Conditions of Interpark Global Shopping Service Electronic Financial Transactions is to set forth relationship between the Company and Users about Electronic Financial Transaction, with respect to the User's use of Payment Gateway Services, Payment Escrow Services and issuance and management of I-Point (hereinafter, collectively referred to as "Electronic Financial Transaction Service" or "EFT Service") provided through internet website (http://globalinterpark.com/ hereinafter "Website") operated by Interpark Corporation ("Company").

Article 2. Definitions

The following terms used in this Terms and Conditions shall have the following meanings.

  1. 1. "Electronic Financial Transaction" or "EFT" shall mean any transaction where the Company provides electronic financial service through electronic devices, which is used by the Users in an automated manner without personally facing or directly communicating with employees of the Company.
  2. 2. "Electronic Payment Transaction" or "EPT" means an electronic financial transaction where a person who makes a payment ("Payor") allows the Company to use electronic payment method and transfer the payment to a person who receives the payment ("Payee").
  3. 3. "Electronic Device" means a device used in electronically transmitting or processing electronic financial transaction information, including without limitation, automatic cash dispenser, automatic teller machine, payment terminal, computer, telephone or other devices which electronically transmits or processes information.
  4. 4. "Access Media" refers means or information used for Transaction Instruction in EFT or ensuring veracity and accuracy of transaction details, and set forth in Article 2 Item 10 of the Electronic Financial Transaction Act, including electronic cards or equivalent electronic data (including credit card information), certificate under Digital Signature Act, user number registered with financial institutions or electronic financial businesses, User's bio information or passwords required for use of such means or information.
  5. 5. "User Number" means any combination of numbers and characters selected by User and approved by the Company for the purpose of identifying such User and using the Service.
  6. 6. "Password" means any combination of numbers and characters selected by a User and approved by the Company for the purpose of identifying such User and protecting user information.
  7. 7. "Transaction Instruction" means User's instruction to a financial institution or an electronic financial company to process EFT in accordance with an EFT agreement..
  8. 8. "Error" means any case where EFT was not made in accordance with User's Transaction Instruction or an ETF agreement without intentional or negligent act of User.
  9. 9. Unless otherwise defined in this Article or other Articles of this Terms and Conditions, all terms shall be governed by relevant laws such as Electronic Financial Transaction Act.
Article 3. Presentation of and Amendment to Terms and Conditions
  1. 1. The Company shall post this Terms and Conditions to the site before the User makes EFT so that the User can check material parts of this Terms and Conditions.
  2. 2. The Company, upon the User’s request, shall distribute (including transmission via email) a copy of this Terms and Condition to the User in the form of electronic document.
  3. 3. In the event the Company amends this Terms and Conditions, the Company shall notify Users by posting such amended Terms and Conditions, by no later than one month prior to effective date thereof, on the screen where financial transaction information is entered and on the Company's website.
Article 4. Transaction Confirmation
  1. 1. The Company shall provide User's transaction details (including information on User's request for correction of Error and result thereof) on ‘Site's 'My Page' or other search screen where the User can check such information. Upon request of the User, the Company shall provide transaction details in writing via fax, mail or personal distribution within two (2) weeks from receipt of the User's request.
  2. 2. Of the transaction details under the preceding Section above, the following information shall be retained for five (5) years:
    1. A. Transaction account name and number
    2. B. Type of transaction and amount at issue
    3. C. Information identifying the other party.
    4. D. Date of transaction
    5. E. Information that allows identification of Electronic Device and the type thereof
    6. F. Access record to Electronic Device related to relevant EFT
  3. 3. Of the transaction details under Section 1 above, the following information shall be retained for one (1) year:
    1. A. Records on de minimis EFTs in the amount of less than KRW 10,000 per transaction
    2. B. Records on transaction approval with regard to the use of electronic payment method
    3. C. User’s request for correction of Errors and results thereof.

Article 5. (Correction of Errors, etc.)
  1. 1. When a User comes to know any Errors in using EFT Service, he or she may request to the Company correction thereof.
  2. 2. Upon receipt of such request as provided in the preceding Section above, the Company shall immediately investigate and resolve it, and inform the User of the result thereof within two (2) weeks from date of receipt of such request.
Article 6 (Generating and Retaining EFT Records)
  1. 1. The Company generates and retains records, from which the User can track or search details of User's EFT, or from which any Error in EFT details, if found, can be checked or corrected.
  2. 2. Types of and methods of storage of the records to be retained by the Company under the preceding Section shall be subject to Section 2 and Section of Article 4.
Article 7 (Withdrawal of Transaction Instruction)
  1. 1. If the User has used EPT, such User may withdraw Transaction Instruction, before the payment becomes effective, by means of transmitting electronic documents (including transmission via email) to the person specified in Section 4, Article 4 of this Terms and Conditions. With regard to each service, Articles 15 and 20 set forth when the withdrawal of Transaction Instruction becomes effective.
  2. 2. If the electronic payment already has been effective, the User may receive refund of the payment in accordance with methods of withdrawing an offer as set forth in relevant laws such as Act on Consumer Protection on Electronic Commerce, Etc.
Article 8 (Non-Disclosure of ETF Information)

The Company shall not provide or disclose to any third party, or use for any purpose other than its business purposes, the User's personal information, account information, Access Media or any information or materials in relation to details and records of EFT obtained from providing EFT Service, except as permitted under laws or without first obtaining the User's consent.

Article 9. Company’s Liability
  1. 1. The Company shall be liable for any damages or losses incurred to the User arising from accidents caused by falsification or forgery of Access Media (only if the Company is the issuer, user or administrator of the Access Media) or in the course of electronically transmitting or processing execution of agreement or Transaction Instruction..
  2. 2. Notwithstanding the preceding Section above, the Company shall not be responsible for damages or losses to the User in any of the following cases:
    1. A. Damages or losses were incurred to the User due to forgery or falsification of Access Media of which the Company is not the issuer
    2. B. The User lends, granted to any third parties use of, or offered for the purpose of transfer or provision as security, Access Media, or he/she disclosed or neglected his Access Media even though he/she knew or should have known that a third party may make EFTs by using the User’s Access Media without authorization;
    3. C. Where a User who is a corporation (excluding small companies as defined under Section 2 of Article 2 of Framework Act on Small and Medium Enterprises) suffers damages, the Company has fulfilled its duty of due care reasonably required by establishment of security measures to prevent any accident and full compliance therewith.
    4. D. Notwithstanding the User's Transaction Instruction, the Company shall not be responsible for any delay or failure to process EFT Service in the event of a force majeure event such as natural disasters, blackouts, fire, network interference or other events beyond control of the Company; provided that the Company notified the User of the reason for such delay or failure (including notification to the User by financial institution or payment medium issuer or online distributors)
  3. 4. In the event the Company temporarily suspends EFT Service for maintenance or replacement of information and communications equipments or facilities, it shall notify Users of such interruption period and reasons therefor in advance on its website.
Article 10. Dispute Resolution and Mediation
  1. 1. A User may request dispute resolution such as damage claims, raise opinions and complaints related to EFTs to the person in charge and the dispute resolution manager specified in the bottom of main page of the Company's website.
  2. 2. In the event the User has applied for such dispute resolution to the Company, the Company shall notify the User of the results of its investigation or resolution of the dispute within fifteen (15) days.
  3. 3. If the User objects to the result of the Company's dispute resolution, he or she may apply for dispute mediation to either the Financial Disputes Mediation Committee of the Financial Supervisory Service under Article 51 of the Act on Establishment of Financial Services Commission or the Consumer Dispute Settlement Commission of the Korea Consumer Agency under Article 31 Paragraph 1 of the Framework Act on Consumers, in connection with use of the Company's EFT Service
Article 11 (The Company's Duty of Security)

In furtherance of ensuring security and reliability for EFTs, the Company complies with standards set forth by Financial Supervisory Commission in relation to IT and electronic financial business such as human resources, facilities, Electronic Devices for electronic transmission or processing.

Article 12 (Rules Other than Terms and Conditions)

Any matters not set forth herein (including definition of terms) shall be governed by consumer protection-related laws, such as Electronic Financial Transaction Act, Act on Consumer Protection in Electronic Commerce, Etc., E-Commerce Act, and Specialized Credit Financial Business Act, and separate terms and conditions.

Article 13 Jurisdiction

Any dispute between the Company and Users shall be submitted to applicable jurisdiction pursuant to the Civil Procedure Act.

Chapter 2. Payment Gateway Services

Article 14. (Definitions)

Terms used in this Chapter shall be defined as follows:

  1. 1. "Payment Gateway Service" means, with respect to the electronic purchase of products or services (collectively referred to as "Products, etc."), a service of transmitting or receiving payment information or agency or intermediation service for settlement of such consideration.
  2. 2. "User" means a person who agrees to this Terms and Conditions and uses Payment Gateway Service provided by the Company.
Article 15. Withdrawal of Transaction Instruction
  1. 1. A User who has used the Payment Gateway Service may withdraw its Transaction Instruction at any time before the amount of Transaction Instruction is (i) recorded in the account ledger of either Company or the financial institution where the Payee’s account is established, or (ii) entered in the Electronic Device.
  2. 2. If no payment transaction has been made due to the User’s withdrawal of the Transaction Instruction, Company shall return the received amount to the User.
Article 16. (Management of Access Media)
  1. 1. The Company, when providing Payment Gateway Service, may select the Access Media and check the User’s identity, authority and the contents of the Transaction Instruction, etc.
  2. 2. The User shall not lend, grant use of, transfer, or grant security interest in, Access Media to any third party.
  3. 3. The User shall not divulge or disclose to any third party, or neglect its Access Media, and shall use a reasonable caution to prevent theft, forgery or falsification of the Access Media.
  4. 4. Upon receipt of the User's notice of theft or loss of his Access Media, the Company shall be liable for losses suffered or sustained by User arising from a third party's use of the Access Media thereafter

Chapter 3. Payment Escrow Service

Article 17. Definitions

Terms used in this Chapter shall be defined as follows:

  1. 1. "Payment Escrow Service" means a service where, in respect of Prepaid Online Sale made in Interpark Corporation, a consumer's payment for products or services (collectively referred to as "Products, etc.") is kept by the Company until the shipment is completed, after which the payment is made to the Seller.
  2. 2. "Prepaid Online Sale" means an online sale where the consumer makes full or partial payment prior to receiving the Products, etc.
  3. 3. "Seller" means a person who agrees to Interpark Corporation Open Market Seller Agreement and Interpark Global Shopping Global Seller Agreement, and engages in online sales business.
  4. 4. "Consumer" means a person who agrees to this Terms and Conditions and purchases the Products, etc., from the Seller who holds a store on the website operated by the Company, and falls under the definition of Article 2 Section 5 of the Act on Consumer Protection in Electronic Commerce, Etc.
  5. 5. "User" means the Seller and the Consumer.
Article 18 (Applicability)

This Chapter is applicable where the User uses the Prepaid Online Telecommunication Sale through ‘Site’.

Article 19 (Release of Payment in Escrow)
  1. 1. The Consumer (including a person to be receiving the Products, etc., if such Consumer consented thereto; the same applies to Section 2 and 3 below) shall notify the Company of his or her receipt of the Products, etc., within three (3) business days therefrom.
  2. 2. Upon receipt of the Consumer's notice of receipt of the Products, etc., the Company shall release the payment to Seller no later than the date specified by the Company.
  3. 3. In the event the Consumer fails to notify the Company of his/her receipt of the Products etc. within three (3) business days therefrom without providing a reasonable explanation, the Company may thereafter release the payment to the Seller without the Consumer’s consent.
  4. 4. The Company shall return the payment to the Consumer if circumstances arise where the Consumer becomes entitled to a refund of the payment before the Company releases the payment to the Seller.
Article 20. Withdrawal of Transaction Instruction
  1. 1. A User who has used the Payment Escrow Service may withdraw his or her Transaction Instruction at any time before the information on the amount of the Transaction Instruction has reached the Electronic Device designated by the Payee.
  2. 2. If no payment transaction has been made due to the User’s withdrawal of the Transaction Instruction, Company shall return the received amount to the User.
Article 21 (Provisions Applicable Mutatis Mutandis)

Article 16 of Chapter 2 hereof, Payment Gateway Services, shall apply mutatis mutandis to this Chapter of Payment Escrow Service.

Chapter 4. I-Point

Article 22 (Definitions)

Terms used in this Chapter shall be defined as follows:

  1. 1. I-POINT (hereinafter referred to as "Points") refers to a medium of payment regulated by the EFTA and issued by the Company after prior notice to the User, which can be used to purchase the Products, etc., and to make payment therefor.
  2. 2. "User" means a person who agrees to this Terms and Conditions, purchases the Products etc., from the Seller and uses the Points to make a payment therefor.
  3. 3. "Seller" shall mean a person who sells the Products, etc., to the User and accepts the Points as a payment method in return for them.
  4. 4. "Access Media" refers to the User Numbers and Passwords registered with the Company or any other means designated by the Company to ensure veracity and accuracy of the User and transaction information or make Transaction Instruction in EFT using the Point.
Article 23. (Management of Access Media)
  1. 1. The Company shall not be responsible for any losses of the amount stored before it receives a User’s notice of loss, theft, and the like of the Point Access Media.
  2. 2. Section 1 through 3 of Article 17 of Chapter 2 (Payment Gateway Services) shall apply mutatis mutandis to the Points provided in this Chapter (Chapter 4. I-Point).
Article 24. (Expiration, Etc.)

Users may use the Points provided by the Company for free through events, etc., only for a period specified by the Company.

Article 25. (Refund, Etc.)
  1. 1. Any User may request and receive a full refund of its entire Points which he owns. However, the refundable Points are limited to those purchased by the User from the Company, and the Points provided to the User for free through events or purchase of products may not be refundable completely or partially.
  2. 2. The Points provided to the User for free through events or purchase of products, etc., can only be used for the period and in the manner specified by the Company, which can be checked on the Company’s announcement at the time of issuance of such Points or on its website.

Addendum

Article 1 (Effective Date)

These Terms and Conditions are effective from April 1, 2022(KST).
